Eligibility

You must be at least 13 years old to use the Application or our website services. If you are under the age of majority where you live, you must have your parent or guardian's consent.

License and Ownership

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes.
• All rights, title, and interest in and to the Application (including trademarks and other intellectual property) remain with Supering.

Accounts and Security

• You are responsible for maintaining the confidentiality of your device and account credentials and for all activities under your account.
• Do not jailbreak or root your device, as it may compromise security and cause the Application to malfunction.

Subscriptions and In-App Purchases

• Certain features are available through paid subscriptions managed by the Apple App Store or Google Play, subject to their terms.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Charges for renewal may occur within 24 hours prior to the end of the current period.
• We use RevenueCat to manage entitlements. Free trials (if offered) and renewals follow your app store’s policies. Refunds are handled by the applicable app store.
• You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. Deleting the Application does not cancel your subscription.

User-Generated Content

• You retain ownership of content you create or upload (e.g., notes, tasks, diary entries, prompts, photos).
• You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely to operate, maintain, and improve the Application’s features. This license ends when your content is deleted from our systems, subject to routine backups.
• You are responsible for your content and must have the necessary rights to submit it. We may remove content or suspend accounts that violate these Terms.

Third-Party Services

Mobile Application: The Application integrates with third-party services (e.g., Supabase for storage/auth, Google OAuth/Calendar, Google AI/Gemini, Apple Health, Google Fit, Expo Notifications, RevenueCat, OpenWeatherMap, xAI/Grok, OpenAI via Supabase edge functions, Resend). Your use of those services may be subject to their terms and policies. We are not responsible for third-party services, networks, or outages.

Website and Waitlist: Our website and waitlist services use third-party services including Google Sheets API for data storage, Loops email service for CRM and email communications, and Vercel Analytics for website analytics. Your use of our website and waitlist services is subject to these third-party services' terms and policies. We are not responsible for third-party services, networks, or outages.

AI Providers and Data Logging

DZIRO automation and daily insights rely on AI providers including Google AI/Gemini, xAI/Grok, and OpenAI routed through Supabase edge functions. Prompts, context, and responses may be stored in Supabase to deliver history, quality improvements, and abuse monitoring. Audio submitted for transcription is processed by Google speech services; we do not retain raw audio after transcription.

Permissions and Sensitive Features

• Location (Optional): With permission, precise and approximate location while you use the app for weather/context features. No background tracking.
• Health (Optional): With permission, Apple Health or Google Fit data for wellness features. You can revoke access at any time.
• Voice (Optional): With permission, microphone audio for speech-to-text, processed through a transcription/AI provider; audio is not retained after transcription.
• Camera (Optional): With permission, capture photos for your notes or diary.
• Calendar (Optional): If enabled, we create or update calendar events using your connected Google account.
• Biometrics (Optional): Device biometric APIs can lock or unlock sensitive screens. Biometric templates remain on your device.

AI-Generated Content

AI responses are generated by our provider (e.g., Google AI/Gemini) based on your inputs and context and may contain inaccuracies. AI output is for informational purposes only and is not medical, legal, financial, or professional advice. Do not rely on AI output in emergencies or for decisions with legal, medical, or financial consequences. You are responsible for how you use AI output.

No Medical Advice; Not a Medical Device

The Application and any health-related features are not intended to diagnose, treat, cure, or prevent any disease or condition and are not a medical device. Consult a qualified professional for medical advice.

Website and Waitlist Services

• By joining our waitlist, you agree to receive email communications about product updates, availability, and related information.
• You can unsubscribe from waitlist communications at any time by clicking the unsubscribe link in our emails or by contacting us.
• We use rate limiting to prevent abuse of our website services. You agree not to attempt to circumvent rate limits or otherwise abuse our services.
• Waitlist signup data is used solely for managing the waitlist and sending communications about product availability.

Acceptable Use

You agree not to reverse engineer, decompile, or attempt to derive source code; bypass security or access controls; violate law or third-party rights; upload malicious code; interfere with service operation; or use the Application or our website services to collect or process unlawful or prohibited content.

Feedback

If you submit feedback or suggestions, you grant us a non-exclusive, royalty-free right to use them for any purpose without obligation to you.

User-Provided API Keys

Certain optional features allow you to provide your own API keys (e.g., Google Gemini, xAI/Grok, OpenWeatherMap). Keys are stored locally on your device and transmitted only to the corresponding provider when you use the feature. You are responsible for safeguarding those keys and for any charges imposed by the provider. Removing the keys in settings will disable the associated functionality.

IP Infringement

If you believe content in the Application infringes your intellectual property rights, email hello@supering.io with a description of the work claimed to be infringed, the allegedly infringing content and its location, and your contact information. We will review and respond under applicable laws.

Availability and Changes

We aim to keep the Application and our website services useful and efficient but do not guarantee uninterrupted or error-free operation. Some features require internet connectivity and may consume data. We may update, suspend, or discontinue the Application or our website services (in whole or in part) at any time. If discontinued, your license ends and you must stop using and remove the Application or cease using our website services.

Disclaimers; Limitation of Liability

• The Application is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement).
• To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of or inability to use the Application.
• To the extent any liability exists that cannot be disclaimed, our total liability for all claims related to the Application will not exceed the amounts you paid (if any) for the Application in the 12 months before the event giving rise to the claim.

Indemnity

You agree to defend, indemnify, and hold harmless Supering from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Application or violation of these Terms or applicable law.

Termination

We may suspend or terminate access for violations of these Terms or harmful behavior. Upon termination, your license ends and you must stop using the Application. You may request export of your content where feasible and permitted by law.

Dispute Resolution

Before pursuing formal action, contact us at hello@supering.io so we can attempt to resolve the issue. If we cannot reach a resolution, you agree that disputes will be exclusively submitted to the state or federal courts located in Wyoming, USA, and you consent to their personal jurisdiction. Nothing in this section limits any mandatory consumer protections available in your jurisdiction.

Force Majeure

We will not be liable for any failure or delay in performance due to events beyond our reasonable control, including acts of God, labor disputes, internet or utility failures, or governmental actions.

Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Consumers in other jurisdictions may have mandatory rights that remain unaffected.

Changes to These Terms

We may modify these Terms from time to time. Updates will be posted in-app or on our website. Continued use constitutes acceptance of the modified Terms.
